Public property in Iraqi law
There is no comprehensive definition of public funds or public property in the Iraqi Constitution or Iraqi laws in a unified form. However, jurisprudence and the judiciary agree that it is:
“Funds belonging to the state or a public legal entity and allocated for the public benefit, whether by nature or by an administrative decision.”
The concept of public property in Iraqi law corresponds to what is known as “public funds” in the texts, which is referred to in laws such as State Property Management Law No. 21 of 1969 and Penal Code No. 111 of 1969.
